Welcome to Coach Feedback (the "Platform"). These Terms and Conditions ("Terms") govern your access to and use of the Platform and its services, including mobile applications, video recording and storage, feedback tools, and related features (collectively, the "Services").
By accessing or using the Services, you ("User," "you," or "your") agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Services.
1.1. Binding Agreement: These Terms constitute a legally binding agreement between you and Correia Kick LLC ("Company," "we," "us," or "our"), a Limited Liability Company organized under the laws of Delaware and operating in California.
1.2. Eligibility: You must be at least 13 years of age to create an account on the Platform. By using the Services, you represent and warrant that you are at least 13 years old. If you are under 13, you are not permitted to use the Services; please have a parent or guardian contact us on your behalf.
1.3. Updates to Terms: We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on the Platform or by other reasonable means. Your continued use of the Services after such notification constitutes your acceptance of the modified Terms.
2.1. Platform Purpose: Coach Feedback is a coaching feedback platform that enables coaches to record video footage, provide feedback on athletic performance, and share that feedback with athletes. Athletes can view their footage, receive coaching feedback, and optionally share highlights publicly.
2.2. Coach Accounts: Coaches may create accounts to record video footage of athletes, provide feedback annotations on footage, organize footage by team or athlete, and manage subscription storage. Coaches require an active subscription to record new footage.
2.3. Athlete Accounts: Athletes may create free accounts to receive and view feedback from coaches, watch footage recorded of their performance, create highlight reels from their footage, and optionally make their profile and highlights public.
2.4. Subscription Services: Coaches may purchase subscription plans to access video recording and storage features. Subscription tiers include:
2.5. AI Features: The Platform may include artificial intelligence features to assist with video analysis, performance insights, and feedback generation. AI features are provided "as is" and should be used as supplementary tools, not replacements for professional coaching judgment.
3.1. Account Creation: To access certain features of the Services, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
3.2. Account Responsibility: You are responsible for safeguarding your account password and for any activities or actions under your account, whether or not you have authorized such activities or actions. You agree to notify us immediately of any unauthorized use of your account.
3.3. One Account Per User: Each user is limited to one account. The creation or use of multiple accounts by a single individual is prohibited and may result in termination of all associated accounts.
3.4. Coach Responsibilities: Coaches who record footage of athletes represent and warrant that they have obtained all necessary consents from athletes and, for minor athletes, from their parents or legal guardians, to record, store, and share such footage through the Platform.
4.1. Video Content: "Video Content" means all videos, recordings, and footage uploaded to or recorded through the Platform by coaches or users.
4.2. Feedback Content: "Feedback Content" means all annotations, comments, voice notes, drawings, and other feedback provided by coaches on Video Content.
4.3. License Grant: By uploading or creating content on the Platform, you grant the Company a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content solely for the purpose of providing and improving the Services.
4.4. Content Ownership: You retain ownership of any Video Content and Feedback Content you create. The Company does not claim ownership of your content.
4.5. Public Profiles: Athletes may choose to make their profile and highlight videos public. By making content public, you understand that such content may be viewed by anyone and may be indexed by search engines.
4.6. Content Representations: You represent and warrant that: (a) you own or have the necessary rights to all content you upload; (b) the content does not violate any third party's rights; and (c) the content complies with all applicable laws.
5.1. Privacy Policy: Your privacy is important to us. Our collection and use of personal information is described in our Privacy Policy, which is incorporated by reference into these Terms.
5.2. COPPA Compliance: We comply with the Children's Online Privacy Protection Act (COPPA). We do not knowingly collect personal information from children under 13. If you are under 13, you are not permitted to use the Services.
5.3. Under 13 Users: If you are under 13, please have a parent or guardian send your team invite code on your behalf. Parents may contact us at support@coachfeedback.app regarding their child's information.
6.1. Subscription: Access to video recording features requires a paid subscription. Fees for subscriptions are as specified on the Platform at the time of purchase.
6.2. Payment: You agree to pay all applicable fees for your subscription. Payments are processed through Apple App Store, Google Play Store, or Stripe via RevenueCat.
6.3. Automatic Renewal: Unless you cancel your subscription before the end of your current billing period, your subscription will automatically renew for the same period, and you authorize us to collect the then-applicable fee using your payment method on file.
6.4. Cancellation: You may cancel your subscription at any time through your account settings or the applicable app store. Upon cancellation, you will retain access to view existing footage but will not be able to record new footage until you resubscribe.
6.5. No Refunds: All subscription fees are non-refundable except as required by applicable law or as otherwise stated herein.
7.1. Storage: Video Content and Feedback Content will be retained on the Platform for as long as your account remains active. We currently retain content indefinitely for active accounts but reserve the right to modify our retention policies with reasonable notice.
7.2. Inactive Accounts: We may delete content from accounts that have been inactive for an extended period (typically two years or more) after providing reasonable notice to the account holder.
7.3. Account Deletion: Upon request, we will delete your account and associated content in accordance with our Privacy Policy, subject to any legal retention requirements.
You agree not to:
9.1. Platform Content: All content on the Platform not provided by users, including text, graphics, logos, icons, software, and the compilation thereof, is the property of the Company and is protected by intellectual property laws.
9.2. Limited License: We grant you a limited, non-exclusive, non-transferable license to access and use the Platform for your personal, non-commercial use in accordance with these Terms.
9.3. Restrictions: You may not copy, modify, distribute, sell, or create derivative works from any Platform content except as expressly permitted.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
THE COMPANY DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING FROM YOUR USE OF THE SERVICES.
IN NO EVENT SHALL THE COMPANY'S TOTAL LIABILITY EXCEED THE GREATER OF: (A) THE AMOUNT YOU HAVE PAID TO THE COMPANY IN THE TWELVE MONTHS PRIOR TO THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).
You agree to indemnify, defend, and hold harmless the Company, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you upload or create on the Platform.
13.1. Governing Law: These Terms shall be governed by the laws of California, without regard to its conflict of laws principles.
13.2. Dispute Resolution: Any dispute arising from these Terms shall be resolved by binding arbitration in Los Angeles, California, administered by JAMS pursuant to its Comprehensive Arbitration Rules. Judgment on the arbitration award may be entered in any court having jurisdiction.
13.3. Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
14.1. By You: You may terminate your account at any time by contacting support@coachfeedback.app or through your account settings.
14.2. By Company: We may suspend or terminate your access to the Services at any time, with or without cause, with or without notice.
14.3. Effect of Termination: Upon termination, your right to use the Services will immediately cease. Provisions that by their nature should survive termination shall survive.
15.1. Entire Agreement: These Terms, together with the Privacy Policy and EULA, constitute the entire agreement between you and the Company regarding the Services.
15.2. Severability: If any provision of these Terms is held unenforceable, that provision shall be modified to the minimum extent necessary, and the remaining provisions shall continue in full force.
15.3. No Waiver: Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.
15.4. Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms at any time without notice.
